Acceptance of Terms

By accessing and using the services provided by PrimeDocumentium B.V. ("Company", "we", "our", or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These Terms of Service govern your use of our website, property rental services, and any related services provided by PrimeDocumentium.

Service Description

PrimeDocumentium provides property rental services including:

• Residential property rentals in Almere and surrounding areas
• Commercial property rentals and leasing services
• Property management services for property owners
• Tenant screening and placement services
• Property maintenance coordination
• Related real estate consultation services

User Obligations

When using our services, you agree to:

• Provide accurate and complete information when making enquiries or applications
• Comply with all applicable laws and regulations
• Respect the rights of property owners, other tenants, and our staff
• Use our services only for legitimate property rental purposes
• Maintain the confidentiality of any sensitive information shared during the rental process
• Notify us promptly of any changes to your contact information or circumstances
• Comply with the terms of any rental agreement you enter into through our services

Prohibited Uses

You may not use our services:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To interfere with or circumvent the security features of our website or services

Rental Agreements

Separate rental agreements will govern the actual tenancy relationship between tenants and property owners. These Terms of Service relate specifically to the use of PrimeDocumentium's services and do not constitute a rental agreement. All rental agreements are subject to Dutch tenancy law and must comply with applicable regulations.

Fees and Payments

Our fees for services will be clearly communicated before any agreement is entered into. Payment terms, including any deposits or service fees, will be specified in writing. All fees are subject to applicable Dutch VAT. We reserve the right to modify our fee structure with appropriate notice.

Intellectual Property

The content, organisation, graphics, design, compilation, magnetic translation, digital conversion and other matters related to our website and services are protected under applicable copyrights, trademarks and other proprietary rights. The copying, redistribution, use or publication by you of any such content or any part of our services is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through our services.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy.

Limitation of Liability

PrimeDocumentium shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. Our total liability for any claims arising from or related to our services shall not exceed the amount of fees paid by you for our services.

Our services are provided "as is" and "as available" without any representations or warranties, express or implied. We do not warrant that our services will be uninterrupted, timely, secure, or error-free. We make no warranties about the accuracy, reliability, completeness, or timeliness of the content, services, software, text, graphics, and links.

Indemnification

You agree to defend, indemnify and hold harmless PrimeDocumentium, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of and access to our services, or your violation of these Terms of Service.

Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms of Service. Upon termination, your right to use our services will cease immediately. The provisions of these Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms of Service is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
